1. Introduction & Acceptance

Welcome to ZuppiBuy, operated by Gpage Technologies Pvt Ltd ("we", "us", "our", "Company").

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and Gpage Technologies Pvt Ltd. By accessing, browsing, or using the ZuppiBuy platform (mobile app, website, and related services), you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use ZuppiBuy.

Scope: These Terms apply to all users including buyers, sellers, and administrators accessing or using our platform.

2. Definitions

Buyer: A registered user who browses and purchases items on ZuppiBuy

Seller: A registered user who lists items for sale on ZuppiBuy

Listing: An item posted for sale, including photos, description, price, and condition

Promotion Package: Paid service that boosts visibility of listings

Coins: Virtual reward currency earned through platform activities

Warranty: Optional product protection service offered through third-party vendors

KYC: Know Your Customer verification process for seller accounts

Admin: Platform personnel authorized to moderate content and enforce policies

Content: Any text, images, videos, or data uploaded by users

3. Account Creation & Responsibilities

Eligibility: You must be at least 18 years old to create an account and use ZuppiBuy.

Truthful Information: You agree to provide accurate, complete, and current information during registration and keep your profile updated.

One Account Per Aadhaar: Each individual may create only ONE account linked to their Aadhaar number. Multiple accounts per person are strictly prohibited and will result in suspension of all accounts.

Account Security:

You are responsible for maintaining the confidentiality of your login credentials
You must notify us immediately of any unauthorized access
You are liable for all activities that occur under your account
Use strong passwords and enable two-factor authentication if available

Account Suspension: We reserve the right to suspend or terminate accounts for violations of these Terms, fraudulent activity, or misuse of the platform.

4. KYC & Verification

Seller Verification Requirement: To list items for sale, you must complete KYC verification by submitting valid government-issued identification (Aadhaar, PAN, Driver's License) and selfie verification.

One Aadhaar Per Account: Each Aadhaar number can be linked to only one ZuppiBuy account. Attempting to create multiple accounts with the same Aadhaar will result in all accounts being suspended.

Effects of Verification:

Verified sellers receive a "Verified" badge on their profile
Enhanced trust and credibility with buyers
Access to premium features and promotional tools

Consequences of False Documents: Submitting fake, altered, or fraudulent documents will result in:

Immediate account suspension or permanent ban
Reporting to appropriate authorities
Legal action as per applicable laws

We take KYC fraud very seriously and will prosecute violations to the fullest extent of the law.

5. Listing Rules & Prohibited Items

5.1 What Can Be Listed

You may list used or new items that are legal to own and sell, including electronics, appliances, furniture, vehicles, and other personal goods.

5.2 Prohibited Items

The following items are strictly prohibited and will result in immediate listing removal and potential account suspension:

Illegal items (drugs, narcotics, counterfeit goods)
Weapons, firearms, ammunition, explosives
Stolen or illegally obtained goods
Adult content, pornography, or sexually explicit material
Live animals (pets may have separate policies)
Hazardous materials without proper authorization
Items that violate intellectual property rights (pirated software, fake branded goods)
Prescription drugs or medical devices without authorization

5.3 Listing Quality Requirements

Photos must be clear, well-lit, and accurately represent the item
No pornographic, violent, or offensive content
No misleading or deceptive descriptions
No copyrighted images used without permission
Accurate pricing and condition assessment

5.4 Duplicate Listings

Creating multiple identical listings for the same item is prohibited. Violators may face listing removal and account warnings.

6. Buyer & Seller Obligations

6.1 Buyer Obligations

Genuine Intent: Only contact sellers if you have genuine intent to purchase
Payment: Complete payment promptly as agreed
Respectful Communication: Communicate professionally and respectfully
Inspection: Inspect items before completing purchase when possible

6.2 Seller Obligations

Accurate Descriptions: Provide truthful, detailed descriptions including any defects or issues
Fair Pricing: Set reasonable prices; no price manipulation
Delivery/Pickup: Fulfill delivery or pickup arrangements as agreed
Warranty Disclosure: Clearly state if item is refurbished and any applicable warranties
Responsive Communication: Respond to buyer inquiries within a reasonable timeframe

6.3 Platform Role

No Guarantee of Sale: ZuppiBuy is a marketplace platform. We do not guarantee that listings will result in sales.

Seller Responsibility: Sellers are solely responsible for the physical goods, their condition, delivery, and any disputes arising from transactions.

No Physical Possession: ZuppiBuy does not take physical possession, inspect, or authenticate items listed by sellers.

7. Promotions & Coins

How Coins Are Earned: Users can earn virtual coins through various platform activities such as completing profiles, verified listings, referrals, and promotional campaigns.

Coin Usage: Coins can be redeemed for promotional boosts, premium features, or discounts on platform services.

Limitations:

Coins have no cash value and cannot be exchanged for money unless explicitly stated in a promotional offer
Coins are non-transferable between accounts
Coins may have expiry dates as specified in promotional terms
Unused coins expire upon account closure

Admin Rights: ZuppiBuy reserves the right to modify coin earning rates, redemption values, and promotional terms at any time with reasonable notice.

Abuse Prevention: Accounts found manipulating the coins system through fraudulent means will be suspended and forfeit all earned coins.

8. Payment, Promotions & Fees

Payment Processing: All payments are processed through secure third-party payment gateways (Razorpay, Cashfree, etc.).

Payment Confirmation: Transactions are completed only upon successful payment confirmation from the gateway.

Taxes: Applicable GST and other taxes will be added to promotional package purchases as per Indian tax laws.

Promotional Packages:

Sellers can purchase promotional packages to boost listing visibility
Package terms (duration, features) are specified at the time of purchase
Payments for promotional packages are generally non-refundable once activated (see Refund Policy)

Platform Fees: ZuppiBuy may charge listing fees, transaction fees, or service charges. All applicable fees will be clearly disclosed before confirmation.

Refunds: Refund eligibility is governed by our Refunds & Cancellation Policy. Please review it carefully.

9. Warranty Terms

Third-Party Warranty: Optional product warranties are provided by third-party warranty service vendors, not by ZuppiBuy.

Coverage: Warranty coverage, terms, conditions, and exclusions are determined by the warranty vendor and provided at the time of purchase.

Claims Process: Warranty claims are handled directly by the warranty partner according to their procedures. ZuppiBuy facilitates the connection but does not process claims.

Platform Role: ZuppiBuy acts solely as a facilitator between users and warranty vendors. We are not responsible for warranty fulfillment, claim denials, or service quality.

Disclaimer: ZuppiBuy makes no representations or warranties regarding the warranty services provided by third parties.

10. Intellectual Property

Platform IP: All content on the ZuppiBuy platform, including but not limited to logos, trademarks, software, design, text, graphics, and functionality, is owned by Gpage Technologies Pvt Ltd and protected by intellectual property laws.

User Content License: By uploading content (photos, videos, descriptions) to ZuppiBuy, you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your content for the purpose of operating and promoting the platform.

You Retain Ownership: You retain all ownership rights to content you upload. The license granted is limited to platform operations.

Restrictions:

You may not copy, reproduce, or distribute ZuppiBuy's proprietary content without permission
You may not reverse engineer, decompile, or extract source code from our platform
You may not use our trademarks without written authorization

11. Moderation & Takedown

Content Moderation: ZuppiBuy reserves the right to monitor, review, and moderate all content posted on the platform.

Right to Remove: We may remove listings, suspend accounts, or take other actions if:

Content violates these Terms or our policies
Content contains prohibited items or inappropriate material
User engages in fraudulent or suspicious activity
Content infringes intellectual property rights
We receive legal requests or court orders

Dispute Handling: Users may report violations through our support system. We will investigate and take appropriate action.

No Obligation: While we strive to maintain a safe platform, we are not obligated to monitor all content and bear no liability for user-generated content.

12. Liability & Disclaimers

AS-IS Platform: ZuppiBuy is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied.

No Warranty on Items: We make no representations or warranties about the quality, safety, legality, or accuracy of items listed by sellers.

Limitation of Liability: To the maximum extent permitted by law, Gpage Technologies Pvt Ltd shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Damages arising from user transactions or disputes
Damages from unauthorized access to user accounts

Liability Cap: Our total liability to you for all claims shall not exceed the amount you paid to ZuppiBuy in the 12 months preceding the claim, or ₹1,000, whichever is greater.

User Indemnity: You agree to indemnify and hold Gpage Technologies Pvt Ltd harmless from any claims, damages, or losses arising from:

Your violation of these Terms
Your listings or transactions
Your infringement of any third-party rights
Your misuse of the platform

13. Termination & Suspension

Your Right to Terminate: You may close your account at any time through account settings or by contacting support.

Our Right to Suspend/Terminate: We may suspend or terminate your account immediately without prior notice if:

You violate these Terms or our policies
You engage in fraudulent, illegal, or harmful activity
You create multiple accounts with the same Aadhaar
You submit false KYC documents
Your account poses security or legal risks
Required by law or legal authority

Effect of Termination:

Your access to the platform will be revoked
All active listings will be removed
Unused coins will be forfeited
Pending transactions may be cancelled
Some data may be retained as per our Privacy Policy and legal obligations

14. Refunds & Disputes

Refund Policy: Refunds for promotional packages, warranty purchases, and other services are subject to our Refunds & Cancellation Policy.

Dispute Process:

Contact the other party (buyer/seller) to resolve the issue directly
If unresolved, submit a dispute ticket through our support system
Provide all relevant evidence (photos, messages, receipts)
Our support team will review and mediate within 7-14 business days
Final decisions are at ZuppiBuy's discretion

Transaction Disputes: For payment disputes or chargebacks, we will cooperate with payment gateways and may temporarily hold funds pending resolution.

15. Governing Law & Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Jurisdiction: Any disputes arising from these Terms or use of ZuppiBuy shall be subject to the exclusive jurisdiction of the courts in [City/State], India.

Dispute Resolution Process:

Informal Resolution: Contact our support team first to attempt informal resolution
Mediation: If unresolved, parties agree to attempt mediation before litigation
Arbitration: Disputes may be referred to arbitration as per Indian Arbitration and Conciliation Act
Consumer Forum: Consumer disputes may be referred to appropriate consumer forums as per the Consumer Protection Act

Class Action Waiver: You agree to resolve disputes individually and waive the right to participate in class actions or representative proceedings.

16. Changes to Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices.

Notification: We will notify you of material changes through:

Updated "Last Updated" date at the top of this page
In-app notifications
Email to your registered address (for significant changes)

Acceptance: Continued use of ZuppiBuy after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the platform and close your account.
